These Terms of Use ("Terms") govern your use of the Nottle mobile application ("App" or "Application") for iOS and Android, and any related services operated by Yurii Liubymov ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
Your use of the App is also subject to our Privacy Policy, available at https://getnottle.com/privacy, which is incorporated into these Terms by reference.
1. About Nottle
Nottle is a personal reflection and mood-tracking tool designed to help users develop self-awareness through daily check-ins, mood logging, and AI-generated observations.
Nottle is not a medical device, therapy service, mental health treatment, or substitute for professional psychological or psychiatric care.
2. MEDICAL DISCLAIMER
PLEASE READ THIS SECTION CAREFULLY BEFORE USING THE APP.
Nottle provides tools for personal reflection, mood tracking, and self-awareness. The App is designed as a personal mirror - a tool for self-discovery and emotional awareness only.
Nottle is not a healthcare or medical provider. Nothing in the App constitutes medical advice, psychological advice, or a therapeutic relationship of any kind.
NOTTLE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR PSYCHOLOGICAL CARE. THE APP IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY MENTAL OR PHYSICAL HEALTH CONDITION.
PRACTICES AND REFLECTIONS CONDUCTED WITH NOTTLE ARE NOT A REPLACEMENT FOR OR A FORM OF THERAPY, NOR ARE THEY INTENDED TO CURE, TREAT, OR DIAGNOSE MEDICAL CONDITIONS. ONLY YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER CAN DO THAT. PLEASE CONSULT WITH A LICENSED PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH.

We reserve the right to include safety information within the App in cases where user-entered content suggests a potential crisis situation.
3. AI-Generated Content - Disclaimer
Nottle uses artificial intelligence (OpenAI's API) to generate observational insights based on your reflection data.
You must understand and accept the following before using AI features:
AI-GENERATED INSIGHTS ARE OBSERVATIONAL ONLY. THEY ARE NOT MEDICAL DIAGNOSES, PSYCHOLOGICAL EVALUATIONS, CLINICAL ASSESSMENTS, OR PROFESSIONAL OPINIONS OF ANY KIND.
AI CAN PRODUCE INACCURATE, INCOMPLETE, IRRELEVANT, OR UNEXPECTED OBSERVATIONS. THIS IS A KNOWN AND INHERENT LIMITATION OF ALL AI SYSTEMS. WE ARE NOT LIABLE FOR ANY DECISIONS, CONCLUSIONS, OR ACTIONS YOU TAKE BASED ON AI-GENERATED CONTENT.
Additionally:
- You are solely responsible for how you interpret and act upon AI-generated content
- AI insights are a tool for self-reflection only - not a source of medical, therapeutic, psychological, or life advice
- Do not use AI insights as a basis for medical or health decisions
- Always consult a qualified professional for any health-related matters
4. Eligibility and Age Requirements
You must be at least 16 years of age to use the App (or 13 years of age in jurisdictions where 13 is the applicable minimum age for digital consent, including COPPA in the United States).
By using the App, you confirm that you meet the applicable age requirement. If you are under the applicable minimum age, you must not use the App.
5. Account and Registration
Nottle does not require account registration to use core features. The App functions on a local-first basis - your data is stored on your device.
If authentication features become available, you are responsible for maintaining the security of your device and access credentials.
6. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal mobile device for personal, non-commercial purposes, subject to these Terms.
This license does not include the right to:
- Copy, modify, or distribute the App or its content
- Reverse engineer or attempt to extract the source code
- Translate the App into other languages or create derivative versions
- Use the App for commercial purposes without our written consent
- Access the App through automated means or bots
7. Intellectual Property
All elements of the App - including software, code, design, graphics, icons, illustrations, the Nottle name and logo, and all written content created by us - are the exclusive property of Yurii Liubimov and are protected by applicable copyright, trademark, and intellectual property laws.
Your content is yours. All reflections, notes, mood entries, and photos you create within the App remain your sole intellectual property. We do not claim any ownership over content you create. We cannot access your content - it is stored locally on your device.
You may not use, copy, reproduce, distribute, or exploit any part of the App's intellectual property without our prior written consent.
8. Rules of Conduct
You agree not to use the App to:
- Violate any applicable law or regulation
- Attempt to hack, reverse engineer, or interfere with the App's operation
- Circumvent any security or technical measures
- Reproduce, distribute, or commercially exploit any part of the App without our consent
- Engage in spam, phishing, or distribute malicious software
- Use the App to build a competing product or service
- Impersonate another person or entity
- Engage in any activity that could harm the App, other users, or us
Violations of these rules may result in immediate suspension or termination of your access to the App, without prior notice and without refund.
9. Subscriptions and Payments
9.1 Free and Premium tiers
Nottle is available as a free app with optional paid features ("Nottle Premium"). Premium features are accessible through a subscription.
9.2 Subscription billing
Subscriptions are billed through the Apple App Store (iOS) or Google Play Store (Android). Payment is charged to your Apple ID or Google account at confirmation of purchase.
9.3 Auto-renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
9.4 Free trial
If a free trial is offered, it will be clearly stated before purchase. If you do not cancel before the trial period ends, your account will be automatically charged for the subscription at the standard price. Cancellation during the trial period will not result in a charge.
9.5 Cancellation
You may cancel your subscription at any time through your device's App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period - you retain access to Premium features until then.
Important: Uninstalling the App does not cancel your subscription. You must actively cancel through the App Store or Play Store.
9.6 Refund policy
We do not issue direct refunds. All payment disputes and refund requests are handled exclusively by:

- Google LLC for Google Play purchases - contact Google Play Support
We do not have access to your billing information and cannot process refunds on your behalf.
9.7 Price changes
We reserve the right to change subscription prices. You will be notified in advance of any price change. Continued use after the change takes effect constitutes acceptance.
10. Consent to Anonymous Data Collection
By using the App, you acknowledge and agree that certain anonymous technical and behavioral data is collected through third-party services (Amplitude and Firebase Crashlytics) to improve the stability, performance, and usability of the App.
This data does not include any personal reflection content, notes, or mood data. It consists solely of technical events and device information as described in our Privacy Policy.
11. Data Loss
Nottle is a local-first application. We do not maintain server-side backups of your data. We are not liable for any loss of data resulting from:
- Deletion of the App
- Device loss, damage, or factory reset
- Use of the "Erase personal data" function within the App
We strongly recommend maintaining regular device backups through iCloud (iOS) or Google One (Android).
12. Third-Party Services
The App integrates third-party services including Amplitude (analytics), Firebase Crashlytics (crash reporting), OpenAI (AI insights), and Supabase (backend infrastructure). Use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
Third-party links within the App (including links to our Terms or Privacy Policy pages) are provided for convenience. We are not responsible for the content or privacy practices of external websites.
13. Device and Connectivity
Certain features of the App require an active internet connection (Wi-Fi or mobile data). We are not responsible for the App failing to function at full capacity due to lack of connectivity or exhausted data allowances.
If you use the App outside your home territory, roaming charges from your mobile provider may apply. You accept responsibility for any such charges.
We recommend not jailbreaking or rooting your device. Doing so may compromise security, expose your device to malware, and may cause the App to function incorrectly or not at all.
14. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or available at all times
- AI-generated content will be accurate, complete, or suitable for any purpose
- The App will meet your specific requirements
15. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, OR LOSS OF USE, DATA, BUSINESS, REVENUES, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE APP AND THESE TERMS, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the extent permitted by applicable law, our total liability arising out of or in connection with these Terms or your use of the App shall not exceed the amounts paid by you to us during the 12 months prior to the event giving rise to the claim.
You use the App at your own risk. The App is provided "AS IS" without any warranties. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any purpose.
16. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your license to use the App ends immediately.
You may stop using the App at any time by deleting it from your device. Deleting the App does not cancel an active subscription — you must cancel separately through the App Store or Play Store.
17. App Updates and Discontinuation
We may update the App from time to time. We recommend accepting updates to ensure continued compatibility and security. We do not guarantee that the App will always be updated to remain compatible with your device's operating system.
We reserve the right to discontinue the App at any time. If the App is discontinued, we will make reasonable efforts to provide advance notice.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. Previous versions are available upon request at support@getnottle.com.
19. Governing Law
These Terms are governed by the laws of Ukraine, without regard to conflict of law principles.
For users located in the European Union, mandatory consumer protection provisions of your country of residence apply and are not overridden by these Terms.
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved amicably by contacting support@getnottle.com. If a dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the courts of Ukraine, unless mandatory local law requires otherwise.
20. Severability
If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall remain in full force.
21. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, superseding any prior agreements or understandings.
